The woman, Dai was helping to babysit her younger sister’s seven-year-old son, while she went to make the meals, she’d told the boy to not go outside to play, but the boy still ran outside, and was run over by the motorist, Wang; the district attorneys prosecuted Wang, and found that Dai had been “negligent in allowing children under fourteen to run across the roads, and she was charged on negligence causing death, the courts found that neither was at fault, and gave them both not-guilty verdicts.
The judge believed, that Dai wasn’t present, that there was no way she could’ve predicted what the child was going to do, to prevent him from getting injured. While Wang was evaluated, as not being negligent by the accident forensic committee, that the boy ran out too suddenly, there was no way he could’ve avoided hitting him.
On September 21st, 2019, Dai was taking care of her younger sister’s seven-year-old son, He, He and Dai’s own daughter were laying outside, Dai went into the house to make the meals, He later run out of the premises of the house, at 10:50 in the morning, he was run over by Wang, who was riding a motorcycle, the boy ran over the double-yellow lines on the road. Dai’s sister didn’t sue her, but the D.A.’s office in Hualien listed her and Wang both as the plaintiffs, and charged them both on negligence death.
During the court sessions, Dai said, that back then, her nephew was playing with her own daughter outside, she’d told the kids to stay in the premises, to not go out, the kids told her that they would stay, then she’d gone into the house, and not saw the children run out on the streets.
The courts found, that the young boy’s running into the streets was by his own means, that he’d gone against what his elders told him not to do, neglected the risks, that it wasn’t something that Dai could’ve foreseen, and she wasn’t present to prevent the accident, that it would be difficult to say, that Dai didn’t follow the laws, that she didn’t perform her duties to supervise the child; there’s no way of confirming that she’d allowed her own nephew to run out, that there’s no neglect on her part.
While for the motorist, Wang, the judge found, that as he saw the boy running onto the streets, there wasn’t enough time for him to slams on the brakes, to avoid running into him, the accident evaluation committee for motor vehicle also did a second evaluation, and confirmed that the motorist wasn’t negligent, also, a not guilty verdict.
And so, a child is DEAD (and yeah, it’s this kid’s own fault!), and nobody’s held accountable for it, because, it wasn’t the aunt’s fault, because she had told the boy to NOT run into the streets, nor the motorist’s fault, because there is NO way he could’ve stopped on time, so, who’s going to pay, for this kid’s loss of life? Oh yeah, nobody, that’s who!
