In the private Der-Fang Home in Zao-Chiao County of Miaoli, the male resident, Lee with autism was found to have been murdered by his caretaker for getting beaten up, tied down, when he’d gotten emotional. The Miaoli D.A.’s Office discovered that Chou, the worker, Lin, the social worker/caretaker, and Lai the executive assistant are all involved in the abuse, yesterday, all three were charged with manslaughter by illegally keeping the victim in custody, and assault charges.
“Too awful!”, the mother of the resident, Lee claimed, during the trials, the three accused all denied the allegations, with absolutely NO remorse, and the investigation results showed that all were lying, that they’d used such a horrid manner to abuse her son, who couldn’t, express himself verbally, she’d hoped that the judge could give all three who’d murdered her son a harsh setn4ece, she also wanted to speak up for the children in the home, hoped that no such tragedy will ever happen again. Toward the D.A.’s decision to drop the indictment of the director of the home, she’d stated, that the director knew of the abusive disciplinary means that the employees used to treat the residents, that she will discuss with her attorney to see.
The D.A. investigations found, that at close to one in the afternoon on July 29th of last year, Lee started getting agitated, Chou, Lin, Lai, three of the employees of the home started beating Lee, and tied him up, kept him locked in his room, and, as Lee broke free from the restraints, they’d beaten him again, by 2:30 in the afternoon that day, they’d tied Lee’s hands behind his back, causing rhabdomyolysis, partially swelling of his brains, subarachnoid hematoma, and other injuries, because of how high the heat was, the resident’s system started failing, by the time he was taken to the hospitals, he was already dead.
The D.A. reviewed the surveillance footages, called in the witnesses to testify to seeing the abuse. And the indictment pointed out, that the three workers had went over the boundaries of discipline, ignored how Lee couldn’t verbalize his needs, not given him enough water or care, not sending him to the E.R., causing his death.
The director of the home, Lin, the caretaker/skills trainer, Jiang were also charged. But the D.A. found, that during the incident, the director Lin wasn’t present, while Jiang was there in the video, but not physically abused the man, that it’s hard to connect them to the behaviors of abuse, the charges against them were both, dropped.
After the case happened, the Miaoli County government’s social services reviewed over the responsibilities of the home, and fined the residential home $300,000N.T., and halted its operations for a year.
And so, this, is still tragic, how this man was, abused to death by his caretakers, and he couldn’t speak, and, what’s worse was these three accused still denied the allegations, even if their bad behaviors were all, caught on tape, and, the director, and the skills’ trainer should also be charged, but, because they did NOT engage in the physical torture of this man, causing him to die, that’s why the charges were dropped against them, when in truth, they’re, JUST as guilty, because they did NOTHING, to stop the abuse!
