She’d Not Hung Up the Phones Before She’d Complained Her Coworker, on the Customer Service Calls, Called the Woman “Crazy Lady”, & Was Sued

The “lesson” to be taken away is???  Oh yeah, make SURE that the phone’s hung up completely, before YOU start complaining about the customers, or, you’ll get, S-U-E-D like this woman here!  Off of the Newspapers, translated…

Using the phones to call to communicate, it has a degree of privacy, but, you may get sued if you’re not, careful enough.  there was once a female service representative who felt upset over how the client didn’t provide her with the authorization number of the credit card, and after she’d hung up on the client, she’d complained to her coworker, “another crazy woman!”, but because the phone wasn’t hung up properly, the client heard her, and the representative got sued, and paid $20,000N.T.s; and there was someone who’d cussed another out on the phones, but because everybody around the person knew who the individual was, referring to, and the individual got sued for public humiliation.

The legal experts pointed out, that in general, phone calls are a one-on-one interaction, that it may only be relative to the two who are talking, but the external environment needed to be taken into consideration, that maybe, people on both sides know who the individuals are, referring to, and if the person cussed another out in public where everybody hears, then, it would be public insult, practically, the number of people needs to be three or more for the charges to constitute as “public humiliation”.

Based off of the verdict of the Kaohsiung District Court, in July of 2018, Hsiao ordered a water fountain from Su’s company, and Su sent out the workers to install the machines, but before the machines were fully installed, she’d started urging Hsiao to pay by credit card; and, Hsiao said that she’d had to wait until the machines are fully installed, before she gives the authorization code off of her credit card, but afterwards, Su didn’t hang up her phone properly, and turned to her coworker to complain: “crazy lady, she refused to give me the last three digits of her credit card!”

As Hsiao heard “crazy lady”, she flew into anger, because the entire conversation was recorded, it’d damaged her reputation, and so, she’d sued the company, as well as the customer service representative, Su, a total of $300,000N.T.s.

In the Simplified Courts of Kaohsiung, during the trial, the judge reviewed over the communication records, and even if no names were mentioned, but based off of the recording, what was happening can be, deducted, the judge mandated that Su and her company needed to pay $20,000N.T. to Hsiao, the case can still be appealed.

And, coincidentally, Chang, the realtor was attracted to a female coworker, Wu, but Wu felt harassed, and complained to the company; after Chang received a warning from his work, he’d called up the woman and cussed her out, so loud, that the entire office KNEW, that Chang was, cussing at Wu.  Later, Wu sued because she was insulted by him, and Chang was charged with public humiliations.

The legal experts stated, that the “public” in “public humiliations”, can be interpreted as a set number of people, or, unspecified number of people, the described above is based off of a set number of persons in an enclosed space; there’s another sort, in the general public, for instance, the upstairs neighbor opened up a window, and cussed the downstairs neighbors out, although, there’s the uncertainties of how many may have heard, but because it’s an opened up environment, it constitutes as “public humiliation”.

And so, the lessons to be learned is: first, don’t cuss anyone out, in public, you can whisper under your breaths, so long as it’s only, loud enough for YOU to hear it, second, there are, difficult people you will meet in this life, and, how you handle your interactions with them, well, that takes, wisdom, and you will need more experiences on that, but basically, IF you want to call someone a bad name, make sure that nobody ELSE (except for yourselves!) can hear it, otherwise, it will, constitute as, public humiliation and you will get S-U-E-D!
