A security guard in Taipei, Cheng, took advantage of his daughter’s friend being mentally incapacitated, used the excuse of “I’ll take you to buy the stereo systems”, given her a lift, and took her to his rented suite to rape, the first trial, the court found the man guilty of raping someone who’s incapacitated, sentenced Cheng to seven years four months, but the second trial gave him a not-guilty verdict. The highest courts found that there were the flaws in the second trial, tossed the case back to be retried, the retrial of the first trial found Cheng guilty of opportunistic rape, sentenced Cheng to three years six months.
Cheng is the long-time friend of the victim’s father, in April of 2017, Cheng first took out a rental suite in Yilan, then, went to the woman’s home to take her to the suite, as he’d gotten her into the room, he’d, pushed her onto the bed, raped her; afterwards, Cheng took the woman to shop at the supermarket, and, about a month later, the woman finally told her families, and her father found out what’d happened, and called the police.
The case went through the guilty, not-guilty, and, retrial cycles, on the first retrial, Cheng admitted to sexual encounters with the woman, but denied the allegations of rape, claimed, that he “didn’t know she was mentally incapacitated”, stated, that the woman flagged down his car, and told him “I like you” in the car, he liked her to, that’s why they had sex together, he’d even gone to the woman’s home, and asked her hand in marriage from the families the following day.
The woman testified, that Cheng had harassed her before, she’d, made the check marks of the encounters on her own calendar of the times. The investigations of the first retrial found that the victim was treated at the psychiatric department of the VMH Yuanshan Branch, the records stated that she’d enjoyed watching porn; with the psych evaluation of the Luodong Hospital, the victim also had multiple sexual intercourses with her past boyfriends as well, and she’d disclosed to her psychotherapist, “I think the next time we meet, we will have sex!”
The first retrial found, that the woman is clear when she was raped, that she’d understood what sex is, but, was lacking on noting the environment, the situations as, dangerous, lacking her self-preservation abilities, that was why she didn’t fight back; and Cheng took advantage of all of these qualities of the woman, raped her, and, committed the crimes of opportunistic rape, but due to how Cheng never admitted that it was rape, and shown no signs of remorse, the courts sentenced him to three years six months.
Yeah, uh, if this is a case I’m ruling over (but it wasn’t!) I would, send this MOTHER FUCKING (don’t pardon me here!), into the general population of the worst prison systems, and see how he liked being someone else’s BITCH, he took advantage of how this woman is mentally incapacitated, and gained her trust, by the fact that he was, her father’s friends, and raped her, and that’s, just, wrong, even IF she seemed easy, even IF she was willing, and you were able, that still doesn’t mean, that you can, and should!
