The Judge: May Have a Lowered Judgment, But Not Completely Incapacitated, Protective Custody for Five Years, Lee’s Mother: I will Accept it, But, Barely
The murdering of the rail police officer, Lee, during the first trial of the perpetrator, Cheng, the courts found that he had schizophrenia, found him not guilty, the D.A. filed for an appeal, the Tainan High Subsidiary Courts used the webcam to declare the verdict, believed that Lee’s control over his own behaviors may have declined, but not to the point of being completely gone, sentenced him to seventeen years for murder, and in protective custody for five years after serving his time, this can still be appealed.
Cheng was taken into custody at the start of this year, as he was told that he received seventeen years, he’d not reacted much, the judge asked him, “Did you hear my verdict?”, Cheng replied, “yes I heard you!”

“It’s better than a not-guilty verdict”. Lee’s mother, Chang who’d learned of the verdict yesterday told the press, that she could accept it but barely, so long as the man who’d murdered her son don’t get away with a not-guilty verdict, she’d felt, a bit relieved; she’d also offered incense to her husband who’d died of distress after their son was, murdered. Although some time had passed, she’d stated yesterday, “it’s still too painful, losing my son.”
The defense attorney, Chen said that he regretted that this was the verdict, and will discuss with Cheng and his families to see if they want to pursue an appeal. Cheng’s wife was listed as a person of interest by the local sanitation office, she was hospitalized due to instability recently, the two daughters were registered as low-income household children, and the social services department is looking in on them regularly.
Cheng was having a delusion that his friend and daughter coconspired to murder him to get the life insurance pay-off, on July 3rd, 2019, he’d gone to report that someone was out to murder him at three other police stations including e An-Nan Substation of Tainan. And as the attendant of the train in Chiayi asked him to get off, he believed that someone was going to murder him, became incoherent, and, stabbed the officer who was called to help the station sort through the matter to death.
During his first trial, the courts believed that as he’d committed the murder he wasn’t in his right mind, that he couldn’t tell that he was doing anything wrong, found him not-guilty, and put him in the psych ward for five years; the verdict caused the public some upset.

The case was then moved to the High Subsidiary Courts in Tainan, the Collectivist Courts considered the evaluations from the VMH in Chiayi and the Chenggong University Psychiatric Department Hospital, the testimonies of the evaluating psychiatrist, believed that when Cheng committed the murder, although he may have a relapse, but not to the point that he’d not known what he was doing was wrong, and, reduced his sentence. Tossed back the original verdict, and, sentenced him to seventeen years in prison, and that after he’d served his time or had been pardoned, he had to be under protective custody in probation for five more years.
The head of the Department of Police Unit, Chen went to Tainan in concerns of the safety, he said that the suspect getting seventeen years, that he was thankful for everybody working so hard, but he will continue to appeal, and insisted that justice be served rightfully.
And so, this is what you get, for murdering someone, when you get diagnosed with a mental condition, you got away from the DEATH penalty, and you don’t even get the life-term, because of how you are diagnosed with schizophrenia, and this is NO justice for the man you’d murdered, or his family either, and so, it’s only right, that the D.A. will be, fighting for another appeal, to overturn the current verdict!
