The Impulsivity of Eighteen…the Military School Student Smashed His Classmate on the Head, Killed Him, Sentenced to Over Six Years

Two Years Ago, the Zhong-Zhen Military Preparatory Academy in July, had a Case of Beating by the Students, the Intern back then, Lo, Tried to Stop the Fight, but He Got into a Fight with a Fellow Student, Chen instead, Lo was accused of picking up a brick, and smashing Chen’s head, causing him to suffer head trauma, turned into a vegetative state, then died, during the trial, the student, Lo reached a settlement agreement with Chen’s family on five million dollars, the Kaohsiung District Courts used the Penal Code 59, reduced his sentence, gave him six years four months, this can be appealed.

The case happened on July 16th, 2018, the seventeen year-old student, Chen got into a fight with another classmate, Wang, the eighteen year-old Lo saw, pulled the two apart, and saw that Chen dragged Wang toward the restrooms, he’d gone up to stop him, and felt displeased by Chen, afterwards, Lo picked up a brick from outside, took it into the classrooms, smashed Chen on the back of the head.

Wang the student who bore witness testified in court, that after he’d refused to get Chen his milk tea, Chen told the intern member, Lo to appoint him to take out the garbage, he kept refusing, Chen started, slapping him around, Lo immediately pull him away; later, Chen kept pushing him into the bathrooms, planned to lock him in; Lo blocked the entrance, Chen shouted, “it’s none of your business!”, Lo replied, “We’re all classmates, why must you do this?”, in the end, Chen threw the first punch, started slapping Lo across the face, and in the end, they were, beating on one another.

Another student, Lee testified, after Lo picked up the brick, and smashed Chen on the head said, “An Eye for an Eye”, then, placed the brick down on the desk, with Chen crying in pain, “Ouch!  What are you doing!”, Chen tried to hit him, but, his head was aching too much, Lo picked up the bricks said, “Are you sure you want to go another round?  I have a brick in my hand”, the other students questioned why Lo had hit Chen, Lo replied, “He hit me while I wasn’t watching back in the bathrooms before!”

Lo claimed in the trials, that he was in the bathrooms originally, to break up the fight, but Chen started swinging at him, it’d made him mad, and he’d, picked up a brick, headed into the class, and smashed Chen, that he’d not intended to kill him.

The Collectivist Court believed, that Lo because of how young and hotheaded he was, without thinking before acting, but considered how he was, trying to, mitigate the disagreement between his classmates, that was why he was involved in the fight, that he’d committed murder out of impulsivity, and he’d started working as an ironsmith, and in the trials, he’d agreed on the five million dollar N.T. settlement agreement with the victim’s family already, considering the related details of the case, they’d decided to employ the Penal Code 59, and reduced his sentence, gave him the verdict of six years four months.

And so, this, is what you get, when you try to break up a fight, and you’re a teenage, which meant, that you are prone to anger, and you have the problems of impulsive control, because that’s, developed, in your, adulthood years, and, given the situations, of how you’d not intended to, murder your classmate, that you were only, standing up for someone who was, getting picked on, and that you’d reached a settlement agreement with the families, that’s why, you only received six years four months, instead of the death penalty, OR life in prison!
