How is this punishment, fitting to this crime that’s nearly “committed”, huh? And, just because you used a gun, and didn’t KILL or INJURE the man you were trying to MURDER or injure, that gave you a free pass, is that it??? A Man, Wang Was Accused of Taking $3,000N.T.s from Someone for a HIT on the Professor, Liao of a Certain Technical University, Because He Forgot to Take the Safety Off, He’d Failed Twice in His Murder Attempt of the Man, Instead, He’d Taken a Steel Bat, Beaten the Man Up, then Ran Off, He Was Charged for Attempted Murder and Other Things by the D.A.’s Office. The Courts Reviewed the Facts, and Decided that Wang Had No Intentions of Killing Liao, Because He’d Not Striked Him Where it Could Cause Fatal Injuries, that He’d Not Shown Any Intent for Murder, So He Was Charged with Physical Assault, and Sentenced to Seven Months in Prison, Which He Can Pay a Fine and Skip the Time Served, and this Can Still Be Appealed.
The police investigated, that Wang (age 38) two years ago on February 17, received an offer of $3,000N.T.s to gun down a lecturer of a certain technical college in Taoyuan, he’d first stole two license plates and installed it onto his own car, then, made his way into the underground garage of the technical university, close to where Liao parked his car, as he saw Liao and his wife approached, he’d aimed from where he was hiding, but forgotten to pull the safety of the gun off, the bullet didn’t fire, and, as he’d gotten out of the car, and pulled the safety off to shoot again, the bullet still didn’t fire off, instead, the bullet fell, straight to the ground.
Liao was thrilled he’d run off, and, Wang grabbed the bat and chased and hit Liao on his left knee and calf, then, ran away, he’d even, dumped the gun barrels, the license plate into the creek. The police based the leads and arrested him, and found the steel bat, the bullet, and what’s left of the gun he used in his trunk. Wang denied having the intention of murdering Liao, said that he’d only fired a shot at Liao’s calf, and later on, he saw that his gun was broken, he’d picked up the iron bat.
The D.A. reviewed over the surveillance at the garage, found that as Wang failed in shooting Liao, he’d picked up the iron bat and chased and beaten Liao, plus, in the cell phone the police took in as evidence from Wang, they’d found Liao’s picture, as well as a photo of his license plate, and that his firing off the shots was quite lethal, the D.A. prosecuted him on attempted murder, grand larceny, and possessions of fire arms.
In the trial, Wang said he didn’t know Liao, and was told that someone wanted to teach Liao a lesson; the courts believed, that it is hard to verify that the man had a strong grudge against Liao, plus, the gun that was taken into custody, after it was examined, was found to have no fatal firepower had it fired off then, and besides, Wang didn’t fire the gun, and Liao was not injured.
Liao testified, that Wang fired at him, but didn’t aim where he was shooting, while Liao’s wife testified, that Liao aimed the gun downward, fired off the shot, then, ran close to her husband, that although she did hear the gun go off, but because of the angle, she’d not seen Wang’s face, she wasn’t sure if he was aiming at her husband or not.
The courts took into considerations, that the way Wang aimed downward as he fired, he had intentions of avoiding the major organs, and besides, there’s no way of being sure if he had, aimed at Liao’s major organs, and that it wasn’t clear if the weapon and ammunitions he used can cause serious injuries or not, so, the judge gave him five months for physical assault, and three months for owning illegal arms, and that he’d needed to serve a total of seven months combined, and that he could pay a fine and get out of serving the time.
And so, this, is what it’s teaching us: if we want to shoot someone, AIM at the parts that won’t cause ANY serious injuries, that way, if and when we get caught, we only get that slap on the wrist, instead of getting charged with ATTEMPTED murder, we’ll only be charged with minor physical assaults, and wow, is that justice??? Hell NO! And yet that was, how the courts ruled……..
