From someone’s personal experiences, in trying to get the labor department to compensate her/him for the loss of ability of work, from the Front Page Sections, translated…
There are traffic accidents every single day, had it not been that I’d gotten involved in one personally, I wouldn’t, see how inhuman the Taiwanese society is.
First, the Barbarisms of the Compensation
Why is it that when a car wreck happens, the involved people are in a battle to see who’s the loudest, and pointing fingers at how it’s the other person’s fault? Because, there’s this barbarism from the compensations, whoever’s more brute, who will be able to, push the fault onto the other man.
And now, every single car had been mandated to be insured for the accidents, and there are folks who’d added on the extra coverages, and so, it may well, change the barbarism of this demanding for the compensations, but, the insurance companies utilized how the laypersons are lacking in knowledge about the laws, or that they’d not wanted to hire the attorneys, to attempt to pay the victims of the crash of with little amount of money; and if you are displeased, do feel free, to SUE us, then, they would, use their team of legal experts, to beat you at the games.
The insurance companies are only willing to pay for the damages to your vehicle and the medical bills, they’d not made a note of how you may have lost the ability to work, and lost the wages you’d needed to live off of, and even if you’d mentioned it, the insurance companies wouldn’t pay you for it, unless you won in court.
Using my crash for example, the insurance company only wanted to pay me off with $20,000 to $30,000N.T.s for the damages of my vehicle, and the medical coverage; and yet, after the case, the attorney included all the loss of labor I’d had to give up, and, asked for over $350,000N.T., and this still doesn’t include the lack of my gaining my abilities back after a year’s worth of surgeries and rehabilitations.
If the lawmakers can help set up a system of reporting the accidents, so the traffic accidents won’t have to make it to court, then, the agency will be able to set up, to estimate the amount, thus, the problem of how much to pay for the victims of traffic accidents get solved. This, is something that the citizens are in dire need of.
Second, the Barbarisms of the Bureaucrats
The labor insurance payments were more humane, compared to the insurance agencies’ coverages of the victims of traffic accidents—the egotism of the systems, and how the systems had, delayed processing, the regulations of the labor insurance came under fire, got twisted, distorted, into a tool that added to the lack of humanism.
From my case, after I still didn’t make my full recovery after my car crash, the attorney told me to get the hospital evaluation that showed that I’d become, decapacitated, to get the assistance from the Department of Labor, but the Department of Labor told me, “You’d already qualified for the elderly assistance, you can’t apply for the disability assistance!”
Reason being, as I had my accident, my shoulder didn’t heal up completely, I couldn’t work effectively, and I’d, quit my job, to focus on getting better, and to help me pass through this period of economic difficulties, I’d, filed for my retirement pension. But, the workers of the Department of Labor had, processed my paperwork as elderly assistance, and, paid me off using my retirement pension given by the Department of Labor. But, as I’d filed for my elderly assistance, I’d lost the qualifications for my retirement pensions. And, if I’d filed for the labor department’s retirement pensions, then, I wouldn’t have this problem. And yet, the person who’d processed my papers failed to tell me this important point regarding my rights.
The systems of office work in Taiwan doesn’t tell the people WHAT rights they have, and when you were stripped of that right, then, they’d tell you of those rules; and, when can the government change to that it tells people of their rights ahead of times, to actively counsel the citizens on helping them getting the most of the benefits.
And so, from this example, you can see, how much lacking IS in this system, and, there would be more problems like this, because of all the fine prints, all of those, unwritten, invisible rules that normal people doesn’t know about, until they needed to file for some claims, and that, is when they’re being told: we can’t give it to you, because you don’t qualify for it, but, nobody told us of these rules in the first place!
