The man, Lai got divorced before he went to serve his jail sentence, his ex-wife Lin married again with their young daughter, and the young daughter was adopted by her current husband; because Lai wanted to visit his own young, and couldn’t, he’d filed for the adoption to be null and void, his ex accused him of not fulfilling the responsibilities of the child’s birthfather, and wanted to destroy her daughter’s happy life now.  In the first and second trials, the courts believed, that back then the child was not yet seven years of age, that the mother allowed her new husband to adopt her daughter, and ruled in favor of Lai, and his ex-wife can appeal.

The second trials, the Collective Courts believed, that the child was only four years of age when she was “adopted”, that it wasn’t consented by the birthfather, Lai, that the child’s adoption was null and void; as for the custody of the child, there needed to be a court case, or both parents needed to come to consensus on.

The verdict pointed out, that Lai and Lin were originally a dating couple, eight years ago, Lin gave birth to a girl, two years later, they got married, but Lai didn’t adopt his own daughter; five years ago, Lai was sent to prison for being a driver in a scam, and made an agreement to divorce with his wife, Lin took her young daughter and moved out of her husband’s home.

In April of 2015, Lai made parole and found out the whereabouts of his wife and daughter, back then, Lin remarried again, and the daughter she had with Lai was now, adopted by her current husband; and because Lai couldn’t have the visitation rights, and the mediation didn’t happen, he’d sued for the adoption to be null and void, Lin stated how after her daughter was born, Lai had failed to live up to the duties of her birthfather, and now, he’d wanted to destroy her daughter’s stable life, and, the adoption was valid with her signing off on it, it didn’t need Lai’s consensus.

But, the judge from the first trial believed, that there wasn’t enough evidence proving how Lai had failed to provide for his own daughter, based off of civil law, the daughter that Lai and Lin had, if needed to be adopted by Lin’s current husband, both parents of the child must agree upon it, but because Lai never agreed to adopting his daughter out, so the adoption was null and void, that Lai won’t the claims; Lin was dissatisfied and filed for an appeal, the Taichung High Subsidiary Courts tossed back her appeal.

So, these adults failed to consider WHAT was in the favor of this young girl, they just wanted to duke it out in court, and they’re both very selfish, especially the father, as he was, destroying the sense of stability that his own young daughter was already living in, fighting for her custody, simply because she was his blood!
