A System of Jury of One’s Own Peers, Like Planting Roses in the Desert?

Do we have a judge who will rule or, do we use the jury systems? This, is the most directly related to the people issue of this current change in the justice systems.

The members of the Fourth Judicial Amending Board pointed out, “the laws can’t be detached from reasoning, and every single ruling eventually returns back to living from day to day.”, those professional judges who lived in the ivory towers wouldn’t KNOW the realities of ordinary living, which is why there’s, this trend of how the rulings don’t reflect the realities now. Besides, the people here had totally lost faith in the government now, this was similar to England and U.S. in the past, and so, Taiwan should implement the policies of the jury system that’s been used a long time in England and the U.S., so someone who’s a layperson who has NO understanding of the law, can objectively tell if someone’s guilty or not.

But, how are the jury systems working out in England and the U.S. currently? The judge from the Higher Courts in Taiwan, Sheng pointed out, that the jury system is a key trait of western worlds, but unfortunately, the system, is on the verge of crumbling down too, he’d interviewed a federal judge from Manhattan, New York last August, and this judge said, that in the four years he’d acted as the federal judge, he was only called to work in a case with a jury, the courthouses are, vacant and, the jury systems had become, borderline now, and, there was, not even one-percent of the cases that relied on the jury systems.

Sheng told, that not only the U.S. became like so, European nations such as Great Britain are like so too, some of the countries had, done away with the jury systems, and, some countries had, obscured or stripped the juries’ rights and powers, to reduce the cases being judged by the juries, the primary reasons being, that a lot of the jurors couldn’t understand the complex laws, and had, made the wrong calls, or that the jury had been influenced, the system cost too much money and time, especially because the jurors didn’t need to state the reason they’d voted, and had, impacted the justness of the legal systems.

So this, is the reforms that the globe is currently undergoing, and, that still just showed, how just because some rule worked someplace else well, doesn’t mean that when the government of a very different culture, nation, language, etc., etc., etc., can make it work too, one-size still does NOT fit all here!!!
