The sixty-six year-old man, Fu was accused of beating his ninety-year-old elderly father with a bat after his father refused to give him any money, at the first trial, the judge found him guilty for abusing his next-of-kin, gave him five months in jail, which he can pay a fine and not serve any time; Fu stated, that he never, abused his father, and went for an appeal, the High Subsidiary Courts in Taichung found, that Fu’s father was demented, and, there was, NO physical proof of him, physically abusing his own father, the verdict was overturned to “not guilty”.
The elderly, Fu accused, that last year in October, after his son got drunk, came home, asked him for money, which he’d, refused, the son picked up a chair, threw it at him, and beaten him with a bat. In the first trial, the judge found the son guilty, the son appealed, stressed that his father was diagnosed with Alzheimer’s, and was delusional, that someone was, beating him, that once he’d visited his parents’ homes, he’d asked his father, “Did you eat?”, and, his father believed, that he was, working with his mother, to poison him, started cursing him out, and often told, that the foreign hired nurse’s aide was going to, poison him too.
On the second trial, the judge called the elderly and his wife to testify, both didn’t show, the judge found, that his wife when she was being asked by the police, couldn’t tell exactly what had happened. The elderly’s daughter testified, that her father would go around and tell others, that she was going to sell their land, and take the money all for herself, and, her show of care and concerns toward him were often, misinterpreted by him, and now, she’d not even, DARED go home to visit her parents anymore, she’d even gotten angered at her father’s accusations, and told him, “You don’t have ANY property under your name, so how can I forcibly occupy it.”
On the second trial, the judge found, that the elderly was diagnosed with dementia, as he’d gone to stay with his daughter up north, he’d insisted on going out, the daughter worried that he might get lost, so she’d hired a foreign nurse’s aide to watch him, and, the elderly called the cops, told them that there was an elderly, being kept against his will at the location. The judge believed, that the elderly, Fu, was often overcome by dizzy spells, was on meds long-term, and would get angry easily, he’d claimed to be beaten by his own son, and the only witness being his own wife, but, she didn’t remember anything that happened on that day, there was, NO clear physical evidence, that he was, physically abused by his son.
So, this, is ONE more problem, that the demented elderly may have, they may have persecutory delusions such as someone beating her/him up, or, someone’s out to get her/him, and, it’s all, a part of the progressions of the illness, and this time, the son didn’t get charged, because the judge couldn’t find ANY physical evidence that this elderly was abused, plus, he was not of sound mind, and that, was why the charges were, dropped.
