Difficulties in Inheritance Rights, Unmarried Heterosexual Couples Having Troubles with the Inheritances After One Dies

An elderly woman, Tsai believed that men who married her will die young, she’d lived with the elderly man, Liu, but never married; Tsai was touched, by how Liu looked after her, care for her after she fell ill and had a stroke, asked her attorney to draft up her will, leaving all of her estates to Liu after she passed, but the government agencies didn’t believe the paper works. Liu sued for the validations, the courts believed that the woman’s will was valid, and ruled that the properties need to get registered under Liu’s name.

The elderly woman, Tsai in Banciao, Hsinbei City, was previously married, but didn’t have any children, after her husband passed away, Liu, her elderly companion had stayed by her side, Liu had wanted to give a rightful status to Tsai, but because the fortune-tellers matched their dates, and found, that Tsai has the tendency, to get the men who married her killed, she’d not wanted to implicate Liu, and denied Liu his proposal of marriage.

Tsai had a stroke back in 2009, Liu stayed by her side through it all; Tsai worried that she will die soon, in January of 2010, she’d asked the scrivener to help her with a living will, stated that the property she’d owned in Banciao is to go to Liu after her passing, she’d asked her two friends, Yang and Bai to be there as witnesses.

Tsai passed away in July of 2014, because she didn’t have any offspring or next-of-kin, her assets became managed by the government; Liu took the living will drafted up by the attorney with Tsai’s signature to the offices, but, the government questioned the authenticities of the documentations, wouldn’t allow him to get anything.

Liu sued for the rights to inherit, the workers of the government ownership official stated, that the will signed by Tsai, the signature wasn’t the same as the signature that Tsai had provided to the accounts in the post office, and, Tsai’s friend who was a witness claimed, that she’d not remembered having been to witness the signing of her will, and questioned the authenticity of the document.

But, the attorney, Lin said, that there were, three witnesses there, and back then, Tsai lost her mobility, had hand tremors, but can still state articulately, she’d written the statements as Tsai had, dictated it, then read to her, to confirm that was what she’d wanted to have done, and, Tsai confirmed that it was okay, and, asked the parties present to sign.

The witness to the will, the elderly, Yang claimed that there are things he can’t remember, he’d only recalled how when Tsai was weakened, she’d started talking about the transfer of the deeds to her property, and that the attorney wrote out what Tsai dictated and he’d read through it afterwards, then, signed.

The courts separated the witnesses and questioned them separately, there’s no conflicting statements, or doubts, and, although the investigative bureau said there wasn’t enough evidence to confirm this, but, the signatures of people doesn’t necessarily stay the exactly the same as always, leading the judge to believe the validity of the will, and found the case in Liu’s favor.

So, maybe, this, is an attempt of the government, to TRY and SCAM some MORE money from an inheritance of a DEAD woman, who knows, but, at least, the facts were, cleared up, and the man got the money left from his cohabiting partner, and this still just shows, how important, having those documentations are, that way, there would be, NO questions, NO doubts, and because these two people weren’t married, that, is why this had, happened…
