A Man Used Excessive Force and Killed the Intruder, Protecting His Own Pregnant Wife, Given Probation for it

You can see, why this man had, used excessive force, to kill the intruder, because he has a wife who’s pregnant!!! From the Front Page Sections, translated…

A man, He and his wife returned to their residence, and bumped into the burglar, Chang, taking things out of their home, He worried that Chang might hurt his wife who was pregnant, he’d immediately grabbed Chang’s collar, caused him to suffocate to death. The Highest Courts in Taiwan believed, that He saw the burglar trembling and face turning white, but still didn’t let go, that he’d used excessive force, in defending his own family, but took into considerations how he’d turned himself into the police, the judge sentenced Chang to two months in prison based off of involuntary manslaughter, that he could pay a fine for it and not serve any time, and he’s on probation for two years.

He’s attorney, Chang stated, that the case may cause a chilling effect, that if someone’s house was broken into, people may wonder if they’d needed to, defend themselves. And, although He only received probation, and not needed to serve any time in jail, he still faced the civil suits.

He and his wife lived in Beitou District, two years ago on the evening of October 25, the couple came home, and, their home was, being burglarized, as He entered into the house, found the burglar, hiding behind the bathroom doors, he’d started punching him, the burglar attempted to escpae, He stopped him, the two of them got into physical altercation.

He pushed Chang, the burglar to the floor in the shower, then, suppressed Chang’s left side of the face with his left hand, at the same time, pulled tight onto Chang’s shirt collar with his right hand, He failed to notice that Chang was turning white, shaking, and suffocating, it wasn’t until the police had arrived, did he stop, but, the thief’s face had already turned black, and became limp, after being rushed to the hospitals, he’d died.

The D.A. prosecuted He based off of involuntary manslaughter, but He said that the thief was hiding in his bathroom, that his wife just got pregnant, he feared that the thief may run out of the bathrooms, and do something awful to his own wife, and that it was, emergent, that he’d only, defended himself. As he saw the thief turned white in the face, he did, let go, and, before the cops came, the burglar was still, moving too.

The first trial gave He a three-month jail sentence for involuntary manslaughter, which he can delay serving for two years; He appealed. The Highest Courts found, that afterwards, He had admitted to the police that he’d subdued the burglar, that he’d met the requirements for a reduced sentence for turning himself in, gave him a lighter sentence.

So, maybe, this man did, use excessive force in stopping the burglar, but, he had his reasons, his wife was just pregnant, and, he’d not wanted the burglar to do any harm to his own wife, which, was what caused him to use so much force, in stopping the burglar, and the courts took that into consideration, so, he was given, a reduced sentence, because he’d not intended to kill the man who was breaking into his house, he was, protecting his own wife.
