A Man Had Beaten a Red Poodle to Blindness, Claimed that it Was Justified, in Protecting Himself

How easily agitated people can get, and the scapegoat here, was a poodle, from the Front Page Sections, translated…

A man, Tsai passed through a florist, and he was displeased at how the red poodle in the shop started barking at him, he’d picked up a wooden board, and beaten the dog blind, the dog owner sued him.  Tsai claimed that if he didn’t hit the dog, he would’ve surely been bitten, but the judge believed, that the poodle was small in size, and couldn’t possibly do too much damage to him, that he’d not needed to use excessive brutal forces in protecting himself, sentenced him to thirty days in jail, and fined him $20,000N.T.s.

Last year in July, Tsai rode his motorcycle past the florist shop, got off his motorcycle to pick up the recycling materials, and there was a red poodle that just barked at him incessantly in the shop, Tsai swung at the dog with a wooden board, the dog had multiple bruises and injuries on its right eye and other parts of its body, and after the owner took it to the vet, the vet diagnosed it with having acute traumatic glaucoma, the vet diagnosed that the dog will never get its sight back again, removed the right eye, and the dog became, handicapped.  The owner felt so awful, she’d sued Tsai for breaching the law of animal protection.  On the first trial, the judge gave Tsai fifty days in jail, plus a fine of $100,000N.T., Tsai felt it was too heavy, and appealed.

“The dog barked at me, and ran toward me, I felt threatened, I’d defended myself, so I’d, beaten the dog up.”  Tsai claimed that he was right in protecting himself, for beating the dog up, that it was, an emergency situation, that he’d broken no laws, that he shouldn’t be punished.

how can something that looks like this be “threatening”???

The judge investigated that Tsai went to the florist to collect the recycling materials, and are acquaintance with the florist, and if Tsai was barked at by the dog, he should’ve asked the owner to restrain his pet; even if the dog made it like it was biting him, Tsai was on his motorcycle and could make his get away easily, plus, it was a poodle, with a smaller body size, that beating it up with a bat was unnecessary, that it didn’t qualify as an emergency event.

The judge took into considerations that Tsai being mildly retarded, with attention-deficit hyperactivity disorder, and didn’t exert enough control over his own behaviors, and that under duress, he had reacted too strongly; plus, he’d made a living doing hard manual labor and recycling, only made $6,000N.T. a month, the judge gave him thirty days in prison, and mandated that he needed to pay $20,000N.T. in fines, and he couldn’t appeal.

So, this man reacted to the dog, barking at him, and, there must’ve been something else that’s bothering him, and the dog barking at him would be the last straw that crushed him, and that, was why he’d lost control of his own behaviors and beaten up the dog so brutally, plus, the man was mentally incapacitated, so that may also have contributed to why he’d reacted so strongly to the dog barking too.
