A case of negligence homicide, from the Newspapers, translated…

Three years ago, a nanny in Hsinbei City, Chou was looking after an infant of a little over fifth months of age with bronchitis, Lin, the infant had a fever of 104, she’d just fed him over-the-counter medications, and bathed him, to try to reduce his fever, delaying the treatment time, causing the infant to die. The Highest Court awhile back sentenced her to negligence homicide, sentenced her to one year ten months in prison, on the civil front, the Hsinbei District Court mandated that she must pay the parents of the infant over $7.1 million N.T.s.

The officers investigated and found, that the male infant was the only son, also, the only grandson in the family, both his parents were government workers, started in April of 2013, the parents gave the three-months-old infant to Chou, who has a valid nanny certificate to look after, asked her to take care of him for the entire day, the very next month, the infant was showing signs of distress, the parents took him to the hospital and the diagnosis of acute bronchitis was the results, since then, he’d been in and out of the hospitals a lot.

By mid-June, the infant boy’s conditions exacerbated, coughed endlessly, and vomited too, had a fever of over 100°F. But, on June 19th, Chou had left the infant boy alone at home, and, by the time she’d gotten home, the infant had a fever of 104°F, but Chou still didn’t take him in, just administered the meds the doctor prescribed for him from the previous time, and bathed the infant to help get his temperature down, she’d taken him to the hospital on the very next day.

But before the infant boy arrived to the hospitals, he had already died, the cause of death was suffocation caused by pneumonia and bronchitis. Afte the infant died, his parents were distraught, their marriage ended as a result too.

The families suspected that Chou didn’t take good care of their offspring, or that she’d not taken him to the hospitals, causing the death of their baby. But she’d denied having been negligent, claimed that she’d stayed up all night, to look after the infant, that when the infant’s conditions exacerbated, she’d rushed him to the hospitals, that she’d done all she was supposed to as a nanny.

At her first trial, the judge gave Chou a two-year eight-months jail sentence, Chou appealed, and the highest courts awhile agoo gave her a year and ten months for negligence death. And, on the charge of how she’d been careless, and hurt the infant boy while she bathed him, she was sentenced to a hundred days in jail, which she could pay a fine for.

The infant’s parents filed for a civil suit asking the courts to make the nanny pay $1.6 million N.T.; the Hsinbei District Court believed, that when the infant was running a fever, the nanny should take the temperatures constantly, to monitor his conditions, and take the infant into the hospital for treatment, and the judge considered Chou’s household economics, and mandated that she needed to pay the mother over $3.96 million N.T.s, and the father over $3.14 million N.T.s, totaling up to about $7.1 million N.T.s.

So yeah, the nanny should’ve done something MORE, she should’ve taken the infant to the hospital when he started having a fever, and that may have been able to prevent him from dying, but she didn’t, and, maybe she did EVERYTHING based off of “protocol”, but this infant boy still died, and, the family was in distress, and, the child’s parents were also, divorced because of it, which was why they’re suing her for emotional distress and causing their family to break up.
