Dangers at school here, from the Newspaper, translated…
A certain elementary school in Yonghe, a fourth grader, Lu, for no reason at all, fly-kicked his classmate, Yang on the head, causing him to suffer from injuries, Lu’s parents, as well as the school asked for Lu to pay them a total of half-a-million dollars, the judge felt that the parents of the child who fly-kicked the other child, Lu, needed to pay fifty thousand dollars N.T., and because they can reproduce any evidence of the school’s negligence, so, the school weren’t responsible at all.
The court investigated, that last year on March 14th, Yang was standing in line outside of class, getting ready to enter into the classroom, saw his classmate, Lu, ran out from the restrooms, quickly, he’d tried to dodge him, but Lu came towards him, and fly-kicked him on the head, Yang fell down to the ground, and was slashed on the eyebrows by Lu, using the aluminum pieces they had for science class, he’d started bleeding nonstop, there was an one-centimeter open wound above his left eyebrow.
Yang’s parents believed, that Lu was bullying their son in school, would kick and punch, also spit at their son, and hurt other classmates as well, that after the incident, he’d still gone to Yang and started screaming at him, for the sake of safety for their son, they could only transfer him to another school. And, because there was such a deep gnash on Yang’s face, it’d damaged his hair follicles, he will be needing an eyebrow transplant in the future too.
The parents also stated, that the school KNEW of how Lu would bully the other students in his class, but didn’t notify the parents in time, nor did the school provide strict surveillance on Lu’s behaviors, or provide counseling to him, and tried to dodge their responsibilities, that the school in negligent, and so, the parents had rights, to ask Lu’s parents, as well as the school, for payment for the eyebrow implant, the hospital fees, and money for psychological damages in the amount of half-a-million dollars N.T.
Lu’s parents said, that they’d already paid for Yang’s medical charges, and the eyebrow implant for the child has NOTHING to do with Yang’s getting his eyebrows damaged, and that there wouldn’t be a need, for them, to pay for the psychological traumas either. The school stated, that this incident has nothing to do with discipline, that it was, purely, an accident, and that it’d not treated this incident as a case of bullying.
The judge believed, that at the time of the incident, Lu was already eleven-years-old, and should know, that fly-kicking someone can hurt the person, and so, he and his parents MUST pay for the damages caused, and because Yang’s parents provided NO evidence that school was neglectful, so, the school didn’t need to pay.
This, is still, a case of bullying, I mean, the kid had priors in bullying this other child from before, and yet, the school didn’t pay attention, and because the kid was hurt, the parents of the bully were made to pay, but what about the school? I mean, this incident DID happen in school, and, shouldn’t the school BE held, equally responsible? After all, when we drop our kids off at school, we’re ENTRUSTING their safety to you, school officials, aren’t we???
